USER AGREEMENT
MBA Career Tour, LLC, hereinafter referred to as “Provider”, represented by Victoria P. Pralich, CEO, acting on the basis of organization Charter, offers services on Provider’s Website http://www.mbacareertour.ru/ to any person or persons, hereinafter referred to as “Applicant” or “Company”, for personal use under the terms and conditions defined below.   
By using the Website http://www.mbacareertour.ru/ you are fully accepting the terms, conditions and disclaimers contained in this notice, without limitations. 
1. Terms and definitions used in the Agreement
1.1. Website represents the content of Internet pages located on the Internet within the domain http://www.mbacareertour.ru/. 
1.2. Applicant/Company (Client) are registered Website users who have placed their personal data, including Résumé/Profiles/Programmes and Internships (hereinafter referred to as “Projects” ) in Provider’s Database for the purpose of job/employee search as well as participation in  Forums, other projects, services and topics of the Website.      
1.3. Provider’s Database – the database of Provider that contains Résumés, as well as Vacancies, Programmes and Internships (hereinafter referred to as “Projects”) and Company profiles placed on the Internet within the domain http://www.mbacareertour.ru/.
1.4. Account information of the Candidate is represented by unique username and password to access the protected pages of the Website. 
1.5. Personal data is data including any information about Candidate (full name, date of birth, address, marital status, education, profession, employment history, other job search information, which Candidate mentions at their discretion). 
1.6. Website user is a person not registered on the Website using its free services.  
1.7. Private account is a closed area of Website which Candidate can access by entering their registration data (login and password) to change and/or remove their personal data and exchange messages with Website Clients.  
2.  Subject of the Agreement.
2.1. Applicant agrees to place their personal data in the form of Résumé, necessary for efficient job search. 
2.2. Allocation of Applicant’s personal data is aimed at job search. 
The period of data allocation is not terminated or restricted by the owner (Applicant) of personal data him/herself. 
2.3. This Agreement shall not be considered as an establishment of either agency relations between Provider and Applicant, or partnership, or joint venture, or private employment, or any other relations non-stipulated by the Agreement explicitly.      
3. Obligations of Provider. 
3.1. Provider is obliged to:
3.1.1. Allow the Applicant compile a Résumé, review projects, respond to them, chat in the forum and use other opportunities of the Website as well.     
3.1.2. Enable the Applicant to control their personal data access. 
3.1.3. Facilitate feedback to the published projects of Website as well as messages exchange between the Applicant and Clients or Website administration in the virtual office system or via e-mail (given the consent of the Applicant during registration) 
3.1.4. Allow the Applicant delete their personal information as well as any other information published on the Website anytime at their discretion.  
3.1.5. In case the Applicant breaches their duties specified in clauses 4.1.1. and 4.1.2. of the given Agreement, Provider has the right to delete the Applicant’s information without notifying the latter.  
3.1.6. The Provider exerts every effort to avoid the Applicant’s personal data abuse by any third parties. However, the Provider is not accountable for possible abuse of the Applicant’s personal data in case of:
•   Software bugs, server or computer network faults beyond the control of Provider; 
•   Website outage due to intentional or unintentional misuse of the Site by third parties; 
•   Password propagation or Site data transfer by the Applicant to other  persons, non-registered users of the Site or other users having no access to the data due to registration requirements and terms of agreements concluded with the Provider. 
4. Obligations of the Applicant
4.1. Applicant is obliged to: 
4.1.1. Follow the regulations of the given Agreement 
4.1.2. Refrain from publishing the information on the Site that violates the RF and international legislation.
4.1.3. Refrain from publishing false information. 
4.1.4. Refrain from posting on and/or transmitting through the Website the materials the Applicant has no rights for.   Those are copyrightable materials, materials under trademarks, information of non-dissemination, confidential information and the like.  
4.1.5. Refrain from violating informational security of the Website. 
4.1.6. Refrain from embedding the executable user code, any other OLE objects, using the frame and iframe, cascading style sheets, the html-code.
4.1.7. Refrain from using names of any other Applicants, employer representatives or employees of Provider registered on the Website. Mislead Website users and administration about their identification in any other way.  
4.1.8. Refrain from deleting and/or change any Web-materials, which are not created by the Applicant. 
4.1.9. Refrain from registering by means of alien e-mail addresses or any other addresses the Applicant has no right to use that way. 
4.1.12. Refrain from sharing the Private account password with third parties. The Applicant bears full responsibility for possible damage to them, the Provider or third parties, incurred by intentional or unintentional password propagation to another person. The Applicant bears responsibility for password confidentiality and any use of the Website by means of their password.   
5. Use of the Website materials
5.1. Every Applicant is responsible for the information published on their behalf and consequences of that publication. 
5.2. Any use of companies’ profiles and projects for other purposes but those related to the subject of the Website (job search, job market information) is illegal. 
5.3. Republication and other use of the Website materials other than  Applicants’ Résumés, companies profiles or projects as well as logos, design elements, the Website appearance and structure are impossible without direct reference (without the redirect) to the Website. 
5.4. Using the Website, the Applicant agrees and admits the right of Provider to use their anonymous and generalized personal data for statistical purposes. 
5.5. The Provider is obliged to refrain from providing any information about Applicant to any private persons or organizations in case they concede unauthorized use of such information (spam, mailing of illegal advertisements, delivery of information to other parties, and the like). However, the Provider is not liable for probable unauthorized use of Website information by the Clients or other parties and/or organizations, resulted from information security violation or Website failure that happened without notice of Provider.   
5.8. In case the Applicant stores his/her Résumé in their personal database off the Website, they are liable for the information within the law “On Personal Data”, as operator of personal data.  
5.9. The use of software tools (scripts, bots) for the Website information readout is not allowed. 6. Final Provisions
6.1. Logos, names, elements of design, desktop and overall appearance are the property of Provider and their use is prohibited. 
6.2. Due to technical difficulty of Internet users identification the Provider does not guarantee true identity of registered users, thus is not liable for possible damage caused to the Applicant and other parties for that reason. The provider does not guarantee the software; servers and computer network are error- and virus-free.  In case the use of Website involved data loss or technical breakdown, the Provider is not liable for the damage.  
6.3. Publishing their personal data on Provider’s Website, Applicant is conscious of and accepts all the risks connected with wide usage of their data by Clients of Provider’s Website. 
6.4. Provider does not guarantee that Résumés published will be reviewed by a certain number of Clients or one Client at least. 
7.   Settlement of Disputes  
7.1. Any and all disputes arising between Applicant and Provider in connection with the present Agreement shall be resolved via negotiations.  
8.2. In case negotiated settlement is impossible, the disputes shall be settled in court.
